PUBLIC NOTICE

In accordance with Section 7-7-213, Miss. Code Ann. (1972), notice is

hereby given that a copy of the 2020 audit of Wayne County is on file in

the Chancery Clerk's office of Wayne County.

In accordance with Section 7-7-221, Miss. Code Ann. (1972), the

following synopsis of the governmental funds of Wayne County audit for

fiscal year ending 9-30-2020 is provided in the format prescribed by the

State Auditor:

Revenue 10-01-19 to 9-30-20, $14,382,870

Expenditures 10-01-19 to 9-30-20, $19,642,763

Cash and investments at 9-30-20, $9,167,134

A copy of the audit report containing all findings and recommendations

as well as exceptions, if applicable, can be obtained for $15.00 or, if

available on the OSA website, $25.00, by writing to the Office of the

State Auditor, Post Office Box 956, Jackson, MS 39205. The website

A copy of the audit report is also on file and available for public

inspection at the Waynesboro-Wayne Co. library.

In accordance with Section 31-7-115, Miss. Code Ann. (1972), the audit

Our findings and recommendations and your responses are disclosed below.

The Inventory Control Clerk should maintain an inventory control system.

Finding: Section 31-7-107, Miss Code Ann. (1972), requires the Inventory

Control Clerk to maintain an inventory control system. An effective

system of internal control over capital assets requires that certain

data elements be captured in capital asset records for all capital

assets. Required data elements include description of assets, cost,

locations, acquisition dates, disposition dates, methods of disposition,

and other relevant information

Response: We are taking steps to comply with recommendations.

Interfund transfers should be approved in the minutes of the Board of

Supervisors' meetings.

Finding: Section 19-3-27, Miss. Code Ann. (1972), requires the

maintenance of a complete and correct record of all proceedings of the

Board of Supervisors

Response: Corrections were made and steps are being made to comply with

the recommendation

The County did not complete the federal grant activity schedule.

Findings: The County did not complete the federal grant activity

schedule for the fiscal year ended September 30, 2020.

Controls over repayment of interfund advances should be strengthened

Findings: The County has interfund loans outstanding that are over one

year old. The loans were not repaid as of September 30, 2020

COMMISSIONER'S NOTICE OF SALE

WHEREAS, on May 5, 2005, Rayar Cartina Johnson and Wester Lee Johnson

executed a Deed of Trust to ReconTrust Company, N.A., Trustee for the

benefit of Mortgage Electronic Registration Systems, Inc., as

Beneficiary, acting solely as Nominee for Capitol One F.S.B., its

successors and assigns, as recorded in Book 1141 at Page 57 in the land

records of the Chancery Clerk of the County of Wayne, Mississippi; and

WHEREAS, the Deed of Trust was assigned to The Bank of New York Mellon

f/k/a The Bank of New York as Trustee for the Certificateholders of the

CWABS, Inc., Asset-Backed Certificates, Series 2005-7 by instrument

dated March 21, 2012, as recorded in the land records of the aforesaid

Chancery Clerk as Instrument No. 201201597; and

WHEREAS, The Bank of New York Mellon f/k/a The Bank of New York as

Trustee for the Certificateholders of the CWABS, Inc., Asset-Backed

Certificates, Series 2005-7, the holder of the Deed of trust and the

note secured thereby, substituted Underwood Law Firm PLLC as Trustee

therein, as authorized by the terms thereof, by instrument dated

December 27, 2018, as recorded in the land records of the aforesaid

Chancery Clerk as Instrument No. 2019000039; and

WHEREAS, on May 18, 2022, the Chancery Court of Wayne County,

Mississippi, entered that certain Summary Judgment and Final Judgment

Against Rayar Cartina Johnson and Wester Lee Johnson and Default

Judgment Against the Unknown Heirs of George O'Harroll and Anita

O'Harroll in the matter of The Bank of New York Mellon f/k/a The Bank

of New York as Trustee for the Registered Holders of CWABS, Inc.

Asset-Backed Certificates, Series 2005-7 v. Rayar Cartina Johnson et

al., Case No. 19-cv-00201, pursuant to which, among other things, the

Deed of Trust was reformed and Underwood Law Firm PLLC was appointed by

the Court as Commissioner to conduct a foreclosure sale of the property

subject to the Deed of Trust, as reformed, in accordance with the terms

of the Deed of Trust, in order to raise the sums due thereunder,

together with Commissioner's fees, attorneys' fees, and expenses of

sale, which Judgment was recorded on May 19, 2022, as Instrument

202201540 in the land records of the aforesaid Chancery Clerk; and

WHEREAS, default having been made in the terms and conditions of the

Deed of Trust and the entire debt secured thereby having been declared

due and payable, in accordance with the terms of the Deed of Trust, and

the legal holder of the indebtedness, The Bank of New York Mellon f/k/a

The Bank of New York as Trustee for Registered Holders of CWABS, Inc.,

Asset-Backed Certificates, Series 2005-7, having requested the

undersigned Commissioner to execute the trust and sell the land and

property in accordance with the terms of the Deed of Trust for the
